SHC Orders Private Schools to Provide Free Education to 10% of Students

The Sindh High Court SHC Sukkur Bench has directed all private schools in the province to provide free education to at least 10 percent of deserving and underprivileged students. Schools that fail to comply with this directive could face suspension of registration, the court warned. In its written judgment, the court emphasized that every private school must allocate free seats based on its total student enrollment. The ruling was issued by a constitutional bench consisting of Justice Zulfiqar Ali Sangi and Justice Riazat Ali Sahar, who expressed serious concern over private schools’ failure to follow earlier court instructions regarding this obligation.
Private Schools Warned of Registration Suspension for Non-Compliance
The SHC also ordered the Director of Private Schools to submit a detailed report within three months on the compliance status of all private educational institutions in Sindh. Justice Zulfiqar Ali Sangi further highlighted that Article 25-A of Pakistan’s Constitution mandates free and compulsory education for all children aged 5 to 16 years.
The court has adjourned the case until November 10. This development aligns with similar actions taken in other regions of Pakistan, where courts have been monitoring the enforcement of this legal requirement. Recently, the Islamabad High Court issued comparable directions, instructing private schools in the capital to confirm their adherence to the 10 percent quota.
Under the Right to Free and Compulsory Education Act, 2012, all private educational institutions in Pakistan are legally required to reserve 10 percent of their admissions for students from low-income backgrounds. Courts have now instructed education authorities to collect and present comprehensive data to ensure that this law is effectively implemented across the country.
